TERMS AND CONDITIONS
1. ORGANIZER
The Ukrainian Charity Ball is organized by the Society of Ukrainian Youth in Austria, abbreviated: TUMA, ZVR number: 270957998, a non-profit organization based at Schönlaterngasse 7/8, 1010 Vienna. Our goal is to raise funds for charitable purposes through cultural events.
2. SCOPE OF APPLICATION
These General Terms and Conditions (GTC) govern the legal relationships between the organizer of the Ukrainian Charity Ball and the attendees of the event or the users of the organizer’s website as well as the web shop (hereinafter referred to as “purchasers”). In addition to these GTC, separate conditions may apply in individual cases, to which separate reference will be made.
3. CONCLUSION OF CONTRACT
The purchase contract for the tickets is concluded as soon as the order has been confirmed by us. Tickets can be purchased via our website, the ticket office, or other distribution channels authorized by us. Before submitting the order, the customer can change, view, or deselect the chosen tickets at any time or cancel the sales process completely. After placing an order via the “Order with obligation to pay” button, the customer makes a binding offer to purchase the products in the shopping cart.
4. PRICES AND PAYMENT
All prices are quoted in euros and include the statutory value-added tax. We reserve the right to increase or decrease ticket prices at any time – particularly depending on demand, availability, and proximity to the event date – up to the point of purchase. The price displayed at the time of the binding order shall be decisive for the respective purchase. Orders already placed are not affected by subsequent price changes. This pricing corresponds to industry-standard procedures, as applied to airline tickets or hotel bookings.
5. CANCELLATION AND REFUND
Ticket orders via the Internet are binding. After the order has been placed, the customer receives an automatically sent email which constitutes the order confirmation. No right of cancellation, exchange, or any other contractual withdrawal is expressly granted. The services offered are leisure services to be provided at a specific point in time or within a precisely specified period. Therefore, the customer is not entitled to the statutory right of withdrawal for distance contracts pursuant to § 18 para. 1 no. 10 FAGG.
6. LIABILITY
As a non-profit organization, we are only liable for intent and gross negligence. Any further liability is excluded.
7. EVENT CHANGES
The organizer reserves the right to make program changes or reschedule the event if required for organizational or safety reasons. In the event of cancellation of the event, the ticket price will be fully refunded; any further claims for reimbursement of the customer’s expenses (e.g., travel or accommodation) do not exist. If the event is aborted, the admission fee will be refunded if less than half of the event has taken place. If more than half of the planned duration of the event has already passed, there is no entitlement to a refund of the admission fee.
8. DATA PROTECTION
The personal data of participants will be processed in accordance with applicable data protection regulations and used exclusively for the processing of ticket sales and the organization of the event. 9. HOUSE RULES
Visitors to the event are subject to the house rules of the Hofburg Festival Halls, which can be accessed on the venue’s website at the following link: https://www.hofburg.com/jart/prj3/hofburg/data/uploads/agb/Hausordnung_Hofburg_Festsaele_2024.pdf
The house rules were approved in accordance with § 27 of the Vienna Event Act 2020 and are binding for all guests, organizers, and their personnel. The instructions of the security staff and event management must be followed at all times.
Persons who violate the house rules or occupy seats without a valid ticket may be expelled from the event without entitlement to a refund of the admission fee.
10. RIGHT OF WITHDRAWAL
There is no right of withdrawal for tickets to fixed-date events. In the case of return or exchange of time-bound goods (e.g., event programmes for a specific event), this only takes place in exceptional cases and within one hour of purchase.
11. USE OF PHOTO AND VIDEO RECORDINGS
By purchasing the tickets, the purchaser agrees to the use of all photos and videos taken during the event by the organizer. The purchaser also gives consent for the use of the photos taken by the organizer during the event for marketing purposes.
12. FINAL PROVISIONS
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, that which comes closest to the economic purpose shall apply. Austrian law shall apply, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods.
